State Farm Specialty Products offers our Miscellaneous Errors & Omissions Liability (Miscellaneous E&O) policy to a wide range of organizations:

  • Auctioneers
  • Billing Services
  • Commercial Printers (see Important Note (2) below)
  • Consultants (non-financial), including Management Consultants (see ineligible services)
  • Convention / Tradeshow Arrangement / Management
  • Copying / Duplication Services
  • Court Reporting Services
  • Direct Mailing & Marketing Services
  • Directory Publishers
  • Dispute Resolution Services
  • Employment Agencies/Executive Search Firms (no placement of healthcare workers; permanent placements only, except for clerical positions)
  • Escrow / Title Agents
  • Event Planning / Consulting
  • Fingerprinting services (ink and electronic scanning)
  • Graphic Design Services (package or product designers are ineligible)
  • Home Inspectors (Traditional only; please see ineligible list; minimum 2 years experience; not available in AK and VT)

If services relating to commercial, industrial, undeveloped land or agricultural real estate exceed 20% of income / commissions, the applicant would not be eligible. Loan modification consulting, foreclosure consulting services and/or foreclosure specialists are also ineligible. Note: CA agents must have $10,000 retention.

    Important Notes (2)
    You may encounter situations where another insurer provides E&O insurance as an endorsement to a business policy or package policy. In such situations, it is a good idea to check our minimum premiums (see Home page). You will find our premiums to be very competitive; however, there are certain situations where we may not be able to match a particular premium.

    Start-up Businesses: Although we do consider the amount of time the applicant has been in business, we are willing to write start-up businesses where the key personnel have adequate experience (typically we want at least one year of experience). The applicant's resume is used to review background and qualifications.

    Claims Experience: The applicant's claims experience will be reviewed by our underwriters.

    Our Miscellaneous Errors & Omissions policy does not cover liability for bodily injury or property damage. We typically do not write professions that have a strong bodily injury / property damage liability exposure. Additionally, the General Liability coverage, often found in Business Package or BOP policies, may exclude liability arising from professional services, so that policy may not cover the bodily injury / property damage liability either.

    For some professions, we offer a Contingent Bodily Injury and/or Property Damage Liability endorsement, which provides contingent coverage under specified circumstances. See endorsements for details.

    Not-For-Profit Directors & Officers Liability with Employment Practices Liability Insurance

    State Farm Specialty Products can offer our Not-For-Profit D&O with EPLI policy to a broad range of not-for-profit organizations, including:

    • Membership organizations, such as chambers of commerce, civic and professional associations, social and sports clubs,
    • Charitable organizations
    • Arts and cultural organizations, such as museums, historical societies, theater groups, choirs, music appreciation societies, etc. 
    • Schools K through 12 (private/not-for-profit)
    • Religious institutions*

    The organization must have, or have applied for tax-exempt status under the U.S. Internal Revenue Code.

    Organizations should have a positive financial condition. If an organization has a negative financial condition, but has demonstrated steady improvement, discuss with underwriting.

    Claims:  No open or pending claims of any kind.   Closed claims should be referred to underwriting

    Many of your existing policyholders belong to these types of organizations and will be very interested in this protection. Additionally, members of such organizations can be good prospects for other State Farm products.

    *Please note that this policy is best suited to independent religious institutions.  If the prospect is a member of a religious organization that has a regional or national governing body, they typically obtain their D&O insurance from that governing body.

    • Correctional facilities, jails, prisons or any service provider to these organizations
    • Credit reporting or counseling
    • Day Care Centers/Nursery Schools
    • Endowment Funds
    • Family Foundations/Charitable Trusts/Private Foundations 
    • Fraternities/Sororities
    • Gaming Commissions
    • Haunted House
    • Health care or medical services (hospitals, nursing homes, assisted living facilities, clinics, blood banks, substance abuse counseling, etc.)  
    • Historical Preservation Foundations 
    • Hospital Foundations / non-profit arms of a hospital or Medical Foundations
    • Housing authorities and Section 8 Housing Developments
    • Insurance providers, including risk retention groups or risk pooling trusts, and managed care providers (including any HMO, PPO or IPO operations)
    • Labor unions
    • Marijuana/cannabis/kratom/CBD manufacturer, warehouse, retailer, or clinic
    • Micro Loan Providers
    • Montessori Schools/Pre-Kindergarten Schools
    • Organizations that are governed under tribal law
    • Political action committees, lobbyists, activists or any group that attempts to influence federal, state or local legislative bodies
    • Political parties/campaigns/fundraising
    • Psychological therapy/counseling services (pregnancy counseling, marriage counseling, family counseling, suicide hotlines, etc.)
    • Public entities (i.e. public officials of any state, city, village or county)
    • Public schools/school districts
    • Realtor/Real Estate Associations
    • Redevelopment and/or development organizations (e.g. land acquisition, construction, renovation, loan services, site planning, permitting or any similar activities)
    • Tax and health districts
    • Tenant Associations or Tenant Rights Organizations
    • Urban League
    • Water Associations/Water Districts/Water Supply Companies or Organizations
    • Any other risk that is considered controversial in nature

    Organizations with open or pending D&O or EPLI claims are not normally eligible (discuss with underwriting). Closed claims will be reviewed by our underwriters.

    Applying for Coverage

    Not-for-profit organizations sometimes put off a discussion of Directors & Officers Liability and Employment Practices Liability Insurance (Not-For-Profit D&O with EPLI) coverage because they don't have a sense of urgency. However, clients should consider this coverage when "times are normal." If they wait until their organization is facing a serious problem, this important protection may not be available or affordable.

    Condo & Homeowner Assoc D&O with EPLI

    NOTE: When requesting a proposal, make sure you use the Condo & Homeowners Assoc. D&O application.

    State Farm Specialty Products can offer our Condominium and Homeowners Association Directors and Officers Liability policy to:

    • Condominium Associations,
    • Homeowners Associations,
    • Cooperatives, and
    • Residential Property Owners Associations
    • Commercial Condo/Property Owners Associations (Note: please use the Not For Profit application if the risk is in Washington.)

    Our policy is best suited for associations with less than 1,000 units. However, we can consider larger associations on a case-by-case basis. An association must have a positive equity/net asset position. Associations with a negative equity position can be considered if the reason is due to the accelerated depreciation of the property.

    We can consider a new condominium or homeowners association. However, the builder or developer must not control more than 50% of the votes on the board and the number of units sold and constructed must be greater than 75% of the total anticipated units.

    The association's Property Manager can normally be added as an additional insured to the policy. The Property Manager must have a minimum of two years experience in property management.

    Claims:  No open or pending claims of any kind.  Closed claims should be referred to underwriting.

    Ineligible Organizations
    Types of organizations that we cannot insure include:

    • Timeshare Associations
    • Mobile Home and/or Manufactured Home Associations
      Assisted Living facilities/nursing homes 
    • Tenant Associations or Tenents Rights Organizations
    • Associations managing uncommon amenities or services such as airports, fire protection services, lakes, rivers or other waterways, etc.
    • Dock or boat slip owners associations (stand-alone)
    • Condo Hotels
    • Corporate owned or sponsored associations / Corporate housing

    We do not insure associations where the builder, developer or sponsor controls the association board (50% or more of the votes).

    We do not insure associations if 50% or more of the units are rented.

    Hardware / Software Installation, Repair and Maintenance Services Training & Education on Software, Systems and Related Applications

    Although we do consider the amount of time the applicant has been in business, we are willing to write start-up businesses where the key personnel have adequate experience. One year of industry experience is generally the minimum requirement. The applicant's resume is used to review background and qualifications.

    Ineligible Businesses
    Technology Services is a constantly changing field with new developments occurring almost daily. Below are some examples of businesses that are not eligible for our Technology Services E&O policy. These are general guidelines and in many cases we may need additional information to properly evaluate an applicant’s services to make an informed underwriting decision:

    • Hardware/component or electronic manufacturers/product developers.
    • Any technology consultant engaged in work for the military, weapons systems, human intelligence systems (HUMINT), avionics, including global positioning systems or any electronic systems used in aviation.
    • Technology consultants engaged in designing ballots, election systems or software or giving advice and/or training to political campaigns
    • Data Brokers/List Brokers/Mail Service Bureaus are not eligible for the Data Breach Endorsement
    • Developers of Operating Systems (including software design or development for these systems). An "Operating System" is a system like Microsoft Windows that operates the computer itself (as opposed to individual programs on the computer).
    • Developers of computer-assisted manufacturing systems or software or process control systems or software.
    • Developers of computer-assisted design and computer-assisted engineering systems.**
    • Education (K-12, College or University) data consultants are not eligible for the Data Breach Endorsement
    • Technology consultants involved in the design, development or maintenance of emergency response or “911” systems.
    • Installation or maintenance of cell phone towers, major computer cabling or major infrastructure systems, television, sound systems or related audio/video equipment.
    • Individuals whose primary role is the installation, maintenance or sale of cellular phone/wireless communications equipment, cable systems or broadcasting equipment.
    • Designers and/or developers of computer/video games, animation, interactive media (CD ROM/DVD), or video production.
    • Design, development, installation or sale of software or systems involving patient care or medical diagnosis or treatment, including systems intended to prevent adverse drug interaction
      Design, development, installation or sale of software or systems involving marijuana/cannabis/kratom/CBD manufacture, storage, distribution including retail outlets or medical clinics.
    • Design, development or consultation on service delivery/pipeline/production systems for utilities
    • Funds transfer, stock/mutual fund/hedge fund trading systems, securities broker/dealer systems, credit card processing systems, automated clearing house (ACH), ATM networks
    • Global positioning systems
    • On-line auction systems
    • Peer-to-peer file sharing for music or videos
    • Social networking services or programs
    • Development of stand-alone search engines/web browsers such as Google, Bing, Yahoo
    • Part-time endeavors, project policies, side gigs, hobbies
    • Product design/engineering and embedded systems - design of products or systems that operate a product or component parts of a product. Embedded systems that operate a product or equipment.
    • Developers of GIS (Geographical Information Systems) software.
    • Technical writers engaged in writing user/owner manuals, product manuals or similar online help content or operating instructions
    • Testing of computer assisted manufacturing systems, process controls or products having a bodily injury/property damage exposure

    **An exception may be possible where the end-user of the system is not depending on the system to produce their final product.

    Accountants Professional Liability

    Who Is Eligible?

    We can offer Accountants Professional Liability to many firms:

    • Gross billings/fee size up to $500,000 at initial review and not exceeding $1 million at future renewals
    • Our target firm is small -- usually employing less than 5 professionals providing individual tax preparation, bookkeeping or compilation services
    • Typically, applicants will be in full-time private practice. However, applicants that operate on a part-time basis are eligible if they have appropriate experience or educational background
    • We write start-up businesses where key personnel have adequate experience or educational background. The applicant's resume is used to review qualifications
    • Claims:  No open or pending claims.  Closed claims should be referred to underwriting

    Note: If 75% or more of the applicant's billings are from one client, we need to review the applicant's contract with that client.

    Ineligible Disciplines
    The following practices are not eligible for our Accountants policy:

    • Firms having more than 50% of services outside of individual tax preparation, bookkeeping or compilation services.
    • Firms that have audited any publicly traded companies in the last 5 years, or
    • Firms that plan to audit any publicly traded company in the next 12 months
    • Firms that perform other services for publicly traded companies are often ineligible - discuss with underwriting before submitting an application
    • Firms that have performed Accounting services, including the preparation of financial statements, in connection with any public offerings, or sales of any securities, in the last 5 years, or
    • Firms that plan to perform Accounting services, including the preparation of financial statements, in connection with any public offerings, or sales of any securities, in the next 12 months.
    • Firms that are primarily management consulting firms, investment management firms, or primarily engaged in the sale of insurance or investments
    • Consultants that specialize in advising clients on Sarbanes-Oxley compliance
    • Accounting firms that outsource some of their services to overseas contractors
    • Daily Money Managers

    Architects and Engineers Professional Liability

    State Farm Specialty Products offers our Architects and Engineers Professional Liability (Architects & Engineers) policy to:

    Eligible licensed professionals engaged in design or land surveying services for small residential and light commercial projects:

    • The firm must have a licensed/registered architect, engineer, interior designer, or surveyor on staff
    • Gross receipts up to $2 million. Certain occupations such as Architects and Civil Engineers will be required to have a minimum of $50,000 in gross receipts to be considered.
    • Applicants must be performing services on a full-time basis.
    • We can write start-up businesses where the key personnel have adequate work experience with another firm. In addition, the applicant must have adequate estimated gross receipts. The applicant's resume is used to review background and qualifications.
    • Claims:  Applicants with claims in the past five years are ineligible.  Other claims experience will be reviewed by underwriting.

    Please note:  This product is not available in Connecticut, Louisiana, or Wyoming.

    Eligible Disciplines

    • Architecture-- Not eligible in Alaska, Kansas, or New Hampshire
    • Civil engineering
    • Electrical engineering
    • Mechanical/HVAC engineering -- Not eligible in Alaska, Kansas, or New Hampshire
    • Land surveyor
    • Interior design
    • Acoustical engineering
    • Illumination engineering
    • Traffic engineering

    The disciplines listed below are often ineligible. However, if these disciplines are only a very small part of the firm's total gross billings, and the type of projects undertaken are acceptable to underwriting, we may be able to write:

    • Structural engineering
    • Naval / marine engineering
    • Process engineering
    • Mining engineering
    • Chemical engineering
    • Incidental construction/project management (architect or engineer acting in the capacity of owners representative or those coordinating subcontractors will be declined.)
    • Testing labs
    • Environmental engineering

    Note: These are the more difficult classes. It is best to discuss such applicants with underwriting before completing an application. Our underwriters will ask about the type of projects that the applicant does.

    Ineligible Professionals
    The following occupations are not eligible for our Architects & Engineers policy:

    • Consultants or architects/engineers primarily engaged in a consulting role 
    • Soils testing
    • Materials testing
    • Alternative fuels/energy engineering and/or consulting
    • Foundation design firms
    • Product design
    • Machinery/equipment design
    • Asbestos abatement contractors
    • Nuclear engineers
    • Aviation engineers
    • Landman
    • Landscape architecture
    • Drafting services
    • Pollution control and toxic waste abatement
    • Seismic work
    • Fire Safety / Protection
    • Professionals engaged in international projects
    • Professional engaged in work on projects for "big box" retailers such as Walmart, Home Depot, Best Buy, etc.

    Dentists Professional Liability

    Our Dentists Professional Liability program is best suited for your neighborhood dentist. This includes:

    • Solo practitioners – a practice owned by the dentist*
    • Small group practices – three or less dentists in the practice*
    *Please note: If the practice operates as a corporation or has a “doing business as” (DBA) name, please provide the name of the corporation or the DBA so that the entity can be properly included in the policy. 

    Eligible Practice Areas:

    • General Dentistry
    • Orthodontists
    • Pediatric Dentists
    • Prosthodontists

    Ineligible Practice Areas:

    • Oral Surgeons
    • Endodontists
    • Periodontists
    • Dental Anesthesiologists (definition in application)
    • Dentists using general anesthesia
    • Dentists who have practiced without insurance for over 30 days
    • Dentists who have a substantial part of their practice in government institutions, such as prison systems, hospitals, schools, etc.
    • Mobile dentists
    • Dental practices with more than three dentists in the practice
    • Dentists involved in franchise operations and/or large national "corporate" dental practices such as those owned by private equity firms or dental practice management companies

    Other Eligibility Considerations:

    • The dentist must have a current, active license. We will be checking the status of their license in the applicable state licensing database.
    • Please obtain a copy of the declarations page of the dentist’s current professional liability policy. We require this to verify coverage and to determine the proper retroactive date.
    • Claims:  Dentists with past claims of any kind are ineligible.

    Employment Practices Liability Insurance

    Who is Eligible?

    State Farm Specialty Products offers Employment Practices insurance to a broad range of industries, including:

    • Construction
    • Manufacturing
    • Wholesale
    • Retail, and
    • Service

    There are a number of underwriting considerations for EPLI:

    • Applicants must have been in business for at least one year.
    • Businesses with up to 500 employees can be considered.
    • Businesses must have a positive financial condition. If a business has a negative financial condition, but has demonstrated steady improvement, discuss with underwriting.
    • We look closely at the employee termination rate in the business.  Businesses with a high employee turnover rate may be considered ineligible.  Discuss with underwriting.
    • Businesses with recent or planned layoffs or downsizings may be considered ineligible.  Discuss with underwriting.
    • Claims - All EPLI claims must be closed for 5 years for coverage consideration. Any other business claim will need to be referred to underwriting for review.

    Note: For California applicants, the maximum policy limit available on new submissions is $500,000 with a minimum policy Retention of $100,000. We will require verification (the applicant’s most recent balance sheet or tax return) showing an equity position of at least $150,000 for binding consideration.

    New!  Third Party Coverage:  For certain businesses we can amend the definition of “Loss and Wrongful Employment Practice” to add third party employment liability as an optional coverage.  This is accomplished by an endorsement.  When added, the endorsement extends coverage for allegations of discrimination or harassment brought by any person(s) who are not individual insureds.  This could include potential claims brought by the public at large while interacting with our insured such as claims brought by customers, patrons or vendors.  There is an additional charge for this coverage.  If the applicant is eligible, the underwriter will offer this coverage on the proposal.

    SPECIAL NOTE FOR STATE FARM AGENTS:  Please do not submit an application for your office.  State Farm Agents are not eligible for EPLI insurance through State Farm Specialty Products because they already carry this coverage.  Questions about your coverage should be directed to your Agency Administration Leader.

    • Apartment building owners - individuals owning and managing their own properties.  (Property management corporations and LLC's are eligible.)

    • Bars/Taverns/Casinos
    • Banks, Savings & Loans
    • Businesses operating out of a home
    • Colleges/Universities
    • Correctional facilities, prisons, jails and/or any service providers to these organizations
    • Employers of domestic staff
    • Employment Agencies
    • Firms or independent contractors that share staff and/or office space that are not under the same ownership or control
    • For-profit businesses utilizing volunteer staff
    • Franchisors and/or sellers of franchises
    • Home healthcare workers/services
    • Hospice workers/services/facilities
    • Hospitals, Nursing Homes, Long Term Care Facilities and Clinics
    • Jimmy John's
    • Marijuana/cannabis/kratom/CBD manufacture, distribution, warehouse, retail sales or medical clinic (any business or enterprise engaged in these activities)
    • Movie/Entertainment Studios, Production Companies or Casting/Talent Agencies
    • Professional Employer Organizations (PEO)
    • Real Estate Service Providers (Agents, Brokers and Property Managers) - Not Eligible in CA
    • Security guard services
    • State Farm offices (see note above)

    Ineligible Businesses for 3rd Party Coverage (may be eligible for EPLI)

    • Ad agencies, public relations firms, marketing firms
    • Education Service Providers/Tutors
    • Finance and Insurance Services (insurance agents, insurance brokers, mortgage brokers, accountants, etc)
    • Fitness Center/Gyms/Fitness Trainers/Yoga Instructors/Dance Studios
    • Golf courses/athletic clubs
    • Government Offices
    • Health Care Providers (doctors, dentists, physical therapists, etc)
    • Hotels/Motels
    • Human Resources Consultants
    • Real Estate Services of any type (real estate agents or brokers, property managers, home escrow services, title agents, etc.)
    • Franchised Restaurants
    • Shopping Centers
    • Spas/Massage/Waxing Services

    Only for-profit entities are eligible for our EPLI policy. State Farm Specialty Products offers a Not-For-Profit Directors & Officers Liability with Employment Practices Liability Insurance policy to not-for-profit organizations.

    Businesses with open or pending EPLI, work comp or other claims are not normally eligible (discuss with underwriting). Closed claims will be reviewed by our underwriters.

    Applying for Coverage
    Businesses sometimes put off consideration of Employment Practices Liability Insurance (EPLI) coverage because they don't have a sense of urgency. However, clients should consider this coverage when "times are normal." If they wait until their company is facing a serious problem, this important protection may not be available or affordable.
